Terms of Service

Welcome to TaleTiles. These Terms of Service (“Terms”) govern your access to and use of the TaleTiles website, online store, mobile application, beta programs, products, and related services (collectively, the “Services”) provided by Fable Dynamic LLC (“TaleTiles,” “we,” “us,” or “our”).

By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Eligibility and Parent/Guardian Use

TaleTiles is intended to be purchased, configured, and managed by adults. If the Services are used by or with a child, that use must be supervised or authorized by a parent or legal guardian.

By using the Services, you represent that you are at least the age of majority in your jurisdiction or are using the Services under the supervision of a parent or legal guardian who agrees to these Terms.

2. Description of the Services

TaleTiles offers storytelling-related products and services, which may include:

• a website and online storefront;
  
  

• waitlists, email communications, and promotional materials;
  
  

• a companion mobile application;
  
  

• beta features and test programs;
  
  

• physical products such as tiles, kits, accessories, or future hardware devices;
  
  

• AI-assisted story, audio, and related content generation features.
  
  

Some features may be experimental, limited, modified, delayed, or discontinued at any time.

3. Beta Features

Certain Services may be labeled as beta, pilot, preview, early access, or test features (“Beta Features”). Beta Features may contain bugs, interruptions, inaccuracies, or incomplete functionality.

You understand and agree that Beta Features are provided on an “as is” and “as available” basis, may change without notice, and may never become generally available.

4. Accounts and Information You Provide

You may be asked to provide certain information to access parts of the Services, including contact, order, shipping, or app-related information. You agree that any information you provide will be accurate, current, and complete.

You are responsible for maintaining the confidentiality of any account credentials and for activity occurring under your account.

5. Orders, Preorders, and Availability

If TaleTiles offers products for sale, all orders are subject to acceptance and availability. We may limit quantities, refuse orders, cancel orders, or discontinue products at any time.

Product descriptions, pricing, availability, launch timing, and feature sets may change without notice.

If we offer preorder, reservation, deposit, or waitlist programs, additional terms may apply and will be disclosed at the time of offer.

6. Pricing and Payments

Prices are shown in the currency displayed at checkout unless otherwise stated. You agree to pay all charges, taxes, shipping fees, and other amounts presented at the time of purchase.

Payment processing may be handled by third-party providers. We do not control those providers and are not responsible for payment-processing errors caused by them.

7. Shipping, Returns, and Refunds

Shipping estimates, delivery dates, and fulfillment timelines are estimates only unless expressly stated otherwise.

Returns, cancellations, and refunds are governed by our applicable return, refund, shipping, or preorder policies, if any. If a separate policy conflicts with these Terms on those issues, the separate policy will control for that specific issue.

8. Acceptable Use

You agree not to:

• use the Services in violation of any law or regulation;
  
  

• interfere with, disrupt, or attempt to gain unauthorized access to the Services or related systems;
  
  

• upload, submit, or transmit content you do not have the right to use;
  
  

• use the Services to create unlawful, abusive, infringing, or harmful content;
  
  

• reverse engineer, scrape, copy, or exploit the Services except as permitted by law;
  
  

• misuse any beta feature, access credential, promotional code, or limited-access program.
  
  

We may suspend or terminate access if we believe you have violated these Terms or created risk for TaleTiles, users, or third parties.

9. User Content and Inputs

You may submit prompts, text, images, preferences, feedback, or other materials through the Services (“User Content”).

You retain rights you may have in your User Content. However, you grant TaleTiles a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, modify, and use that User Content as reasonably necessary to operate, improve, support, and provide the Services.

You represent that you have all rights necessary to submit User Content and that your User Content does not violate any law or third-party rights.

Please do not submit sensitive personal information, especially about children, in free-text prompts or messages unless necessary for the specific use of the Services.

10. AI-Generated Content

Some TaleTiles features use artificial intelligence to generate stories, narration, audio, recommendations, or other outputs.

AI-generated content may be incomplete, inaccurate, repetitive, unexpected, or unsuitable in some contexts. You are responsible for reviewing outputs before relying on or sharing them.

TaleTiles does not guarantee that AI-generated outputs will always be accurate, unique, available, or appropriate for every child, family, or situation.

The Services are not intended to provide medical, mental health, legal, educational, or other professional advice.

11. Family and Child Safety

TaleTiles is designed for family use, but parents and guardians are responsible for supervising child use, selecting age-appropriate settings, and determining whether specific stories, prompts, or outputs are appropriate for their household.

Any references to “screen-free,” “audio-first,” or similar language describe the intended child experience and do not mean that no screen, app, internet connection, or device is used anywhere in the overall system.

12. Intellectual Property

The Services, including the TaleTiles name, branding, website content, software, designs, graphics, audio, interfaces, and other materials, are owned by TaleTiles or its licensors and are protected by intellectual property laws.

Except for limited rights to use the Services in accordance with these Terms, no rights are granted to you.

You may not copy, reproduce, modify, distribute, sell, sublicense, or create derivative works from the Services except as expressly permitted in writing.

13. Feedback

If you provide suggestions, ideas, bug reports, or other feedback, you grant TaleTiles the right to use that feedback without restriction or compensation to you.

14. Third-Party Services

The Services may rely on or link to third-party services, platforms, payment processors, app stores, analytics providers, hosting providers, or AI providers.

We are not responsible for third-party services, and your use of them may be subject to separate third-party terms and policies.

15. Service Availability and Changes

We may update, modify, suspend, or discontinue any part of the Services at any time, with or without notice.

We do not guarantee uninterrupted availability, compatibility, or error-free operation.

16. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES AND ALL PRODUCTS, CONTENT, AND FEATURES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TALETILES DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

17. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TALETILES AND ITS AFFILIATES, OFFICERS, EMPLOYEES, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, REVENUE, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO THE SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF TALETILES FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF:
(a) THE AMOUNT YOU PAID TO TALETILES FOR THE RELEVANT PRODUCT OR SERVICE IN THE 12 MONTHS BEFORE THE CLAIM, OR
(b) USD $100.

Some jurisdictions do not allow certain disclaimers or limitations, so some of the above may not apply to you.

18. Indemnification

You agree to defend, indemnify, and hold harmless TaleTiles and its affiliates, officers, employees, contractors, licensors, and service providers from and against claims, liabilities, damages, losses, and expenses arising out of or related to:

• your use of the Services;
  
  

• your User Content;
  
  

• your violation of these Terms; or
  
  

• your violation of any law or third-party right.
  
  

19. Termination

We may suspend or terminate your access to the Services at any time if we believe you violated these Terms, created risk, or misused the Services.

Sections that by their nature should survive termination will survive, including ownership, disclaimers, limitations of liability, indemnity, and dispute-related provisions.

20. Governing Law

These Terms are governed by the laws of the State of Colorado, without regard to conflict of laws principles, except to the extent superseded by applicable federal law.

21. Disputes

Any dispute arising out of or relating to these Terms or the Services shall be brought in the state or federal courts located in Colorado, and you consent to the personal jurisdiction and venue of those courts, unless applicable law requires otherwise.

22. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the Effective Date above. Your continued use of the Services after updated Terms become effective means you accept the updated Terms.
